EPA issues permits for Class VI wells in all states except North Dakota, Wyoming and Louisiana, which have each secured EPA’s permission to issue those permits through their state agencies. Texas has applied for such primacy; the Texas Railroad Commission already oversees Class II wells.

Paige Powell, senior policy manager at the watchdog organization Commission Shift, expressed concerns about oversight in an interview Wednesday. EPA has only permitted a handful of Class VI permits nationally, she said, and the Railroad Commission is not adequately overseeing Class II injection.

“There’s just not enough oversight and we’re seeing crumbling infrastructure and overpressurization of the subsurface,” Powell said.
